Pest-Free Partnership Agreement & Terms of Service
Purpose of This Agreement
This agreement explains how Planet Friendly Pest Control (“PFPC”) works, what you can expect from us, and what we need from you for pest control to work the right way. Our goal is simple. Protect your home, your pets, and your peace of mind. We do this through inspection-driven, targeted treatments. Not excessive product use. By starting or continuing service with PFPC, you agree to the terms below.
1. What “Pest-Free” Means
“Pest-free” does not mean a sterile environment or the elimination of all insect life.
It means:
- Pest activity is kept at manageable, non-disruptive levels
- Conditions that attract pests are identified and reduced
- Your home is protected using the least amount of product necessary
Insects are part of the environment. Our job is to keep them from becoming a problem in or around your home.
2. This Is a Partnership
Effective pest control depends on shared responsibility.
PFPC’s Role
We will:
- Inspect your property during each scheduled visit
- Identify pest-conducive conditions when present
- Provide a written inspection report when conditions of concern are identified or when recommendations are required
- Apply targeted, inspection-driven treatments where appropriate
Your Role
You agree to:
- Address reasonable recommendations listed in any applicable written inspection report
- Correct conditions that contribute to pest activity, such as moisture issues, entry points, sanitation, or storage
- Notify PFPC of structural or environmental changes that may affect pest activity
Failure to address documented conditions, when provided in a written inspection report, may limit the effectiveness of service and the applicability of guarantees.
3. PFPC Pest-Free Guarantee
PFPC provides a one-year service partnership.
If:
- You follow the written recommendations provided in any applicable inspection reports within a reasonable timeframe, and
- You remain dissatisfied with the results
You may cancel the remaining portion of the annual service term without responsibility for unpaid future service fees.
This guarantee:
- Does not provide refunds for services already performed
- Applies only to pests covered under your selected program
- Does not apply when documented recommendations are not addressed
This guarantee reflects professional accountability, not unlimited liability.
4. Covered Pests and Exclusions
Unless specifically included in a separate written agreement, the following are not covered under standard pest programs:
- Flying insects
- Wood-destroying insects, including termites, carpenter ants, carpenter bees, and wood-boring beetles
- Bed bugs
- Cockroaches
- Pantry pests
- Interior flea infestations
- Carpet beetles
Specialized services are available under separate agreements.
5. Term, Renewal, and Cancellation
Automatic Renewal
Recurring pest, rodent, termite, lawn, shrub, and perimeter programs automatically renew annually on January 1, unless canceled.
You may cancel at any time by:
- Emailing service@planetfriendlypestcontrol.com, or
- Contacting PFPC directly
Where required by Maryland or Virginia law, renewal reminders may be provided prior to renewal.
No Long-Term Lock-In
You may stop, change, or cancel recurring services at any time. Charges already earned for services performed remain due.
6. Payment Terms
- Invoices unpaid after 30 days are considered delinquent
- A service charge of up to 2% per month may apply to delinquent balances
- Services may be suspended while an account is past due
- Returned checks are subject to a $45 service fee
- You are responsible for reasonable collection costs and attorney fees as permitted by law
7. Chemical Sensitivity and Pet Considerations
You must notify PFPC in writing before service if any person or pet may be sensitive to pest control products. Upon written request, PFPC will provide available product information and may discuss alternative control methods. Failure to provide written notice before service releases PFPC from responsibility related to undisclosed sensitivities.
8. Important Legal Terms – Please Read Carefully
No Express or Implied Warranty
Except for any express guarantee you have elected, services are provided without implied warranties of merchantability or fitness for a particular purpose, to the extent permitted by law. Nothing in this agreement limits rights provided under applicable Maryland or Virginia consumer protection laws.
Limitation of Liability
To the maximum extent permitted by law:
- PFPC is not liable for indirect, incidental, or consequential damages
- PFPC’s total liability shall not exceed the amount paid by you for the specific service giving rise to the claim
These limitations do not apply where prohibited by law.
9. Access, Property Changes, and Transfers
- Service may be suspended or terminated if PFPC cannot reasonably access the property
- This agreement applies only to the structure as it existed at the time of inspection
- Structural changes require notification and may require re-inspection at additional cost
- This agreement terminates upon transfer of property ownership unless a new agreement is executed
10. Non-Solicitation
You agree not to knowingly solicit or hire PFPC employees during active service and for 12 months after service ends.
11. Mediation and Arbitration
Any dispute arising out of or relating to this agreement or the services provided shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) on an individual basis. Class actions and representative actions are not permitted.
Venue for Non-Arbitrable Claims
Any claim or dispute arising out of or relating to this Agreement or the services provided that is not eligible for arbitration, or that a court determines may not be arbitrated, shall be resolved exclusively in the state or federal courts located in Calvert County, Maryland, to the extent permitted by applicable law.
The parties knowingly and voluntarily consent to personal jurisdiction and venue in such courts.
12. Entire Agreement
This document, together with any written inspection reports, graphs, specifications, or express guarantees issued by PFPC, constitutes the entire agreement between the parties. No verbal statements or representations alter this agreement. Any changes must be in writing and signed by both parties.
Pest control works best when expectations are clear and decisions are thoughtful. If this approach aligns with how you want your home protected, we’re glad to work with you. If it doesn’t, we respect that as well.
By authorizing service, you acknowledge that you have read, understood, and agreed to these terms.
